State now limits validity of licenses and IDs for non-immigrant residents to expiration of federal documentation
The Office of the Honorable Dariel Fernandez, Miami-Dade County Tax Collector, is alerting residents to an important update from the Florida Department of Highway Safety and Motor Vehicles (FLHSMV) that affects the issuance and renewal of driver licenses and ID cards for non-immigrant individuals.
Effective immediately, under Florida Statutes 322.051 and 322.18, the FLHSMV has changed how long licenses and identification cards will remain valid for individuals who are not U.S. citizens or permanent residents but have legal immigration status.
What non-immigrant residents need to know
Under the new policy, driver licenses and ID cards issued to non-immigrant individuals will only be valid until the expiration date listed on their U.S. Citizenship and Immigration Services (USCIS) documents. If no expiration date is provided, the credential will be limited to one year from the date of issuance.
This change means:
- All non-immigrant license and ID applicants must present current USCIS documentation with a listed expiration.
- If documentation has no end date, the issued credential is valid for no more than one year.
- These rules are now in full effect across Florida.
The policy aims to better align state-issued identification with federal immigration records. While the Miami-Dade County Tax Collector’s Office does not set this policy, it plays a crucial role in informing the public and assisting with related services.
